Working Meeting, January 25, 2007

Members Present:
Richard Zahn, Neil Bohnett, Trudy Feldkamp, Keith Girbach, Laurie Leinbach, Chuck Rankin

Members Absent:
Denny Zink

Others Present:
Jim Marion (Supervisor), Dan Cabage, Rodney Nanney, approximately 10 others

Meeting was called to order at 7:35 pm.

Roll was taken; six members present; quorum established.

Pledge of Allegiance was led by Girbach.

Continued work on Plan update. Don is ill and unable to attend.

For next meeting (February 14), Articles 6 and 11 for review. The last two sections will be sent. In current version, these items are together. Items special to developments have been pulled and put in a separate section. Wind power verbiage has been added. Changes: wireless information is all together including procedures. All standards are drawn together. Eliminated ½ mile within US12; left in distance between towers (page 11-16). Page 11-12 & 13, another chart. 11-21, section 11.04, Water Supply & Sanitary Sewerage Facilities: language for community systems. Will need to review ordinance. Page 11-22, Natural Features Protection: includes wetlands, water ways, and steep slopes.

Article 6: misc stuff ordinance, added fences, swimming pools.

Article 1, Administration and Enforcement: Roles and responsibilities fo various boards/commissions.
Page 1-6: added "Planner"
Page 1-7, Section 1.07: "Permit" and "Certificate of Zoning"? Leave both or eliminate one? Check with Robert Marion (zoning inspector)
Section 1.08: Fees included.
Page 1-12, Violations & Penalties: moves from misdemeanor to municipal civil infraction (similar to a traffic ticket).

Article 2, Zoning Districts: Details moved to charts/graphs. Some new districts added.

Article 17, Zoning Board of Appeals: Main change in on page 17-7, standards for variance. Variances should be difficult to obtain. Language has been added to give the Board guidance.
Section 17.11, Limitations: ZBA cannot deal with use variances.

Fiber Tower has submitted an application for a special use permit. Materials will be copied and distributed. Discussion will be on agenda for the February 14 meeting.
